The Freedom of Information (Scotland) Act 2002 (FOISA) gives individuals a right of access to all recorded information held by public authorities. It is designed to promote greater accountability and openness by public authorities for their communities and residents.

Under section 23 of FOISA each public authority must produce and maintain a publication scheme outlining:

  • the classes of information that it publishes or intends to publish in the future
  • the manner in which information is made available
  • whether the information is available free or at a charge.

A publication scheme sets out the types of information that a public authority routinely makes available.  Publication schemes are intended to encourage organisations to publish more information proactively and to develop a greater culture of openness. This publication scheme brings together the different types of information together in a structured way and provides detail as to how it can be obtained: this aims to save you time and effort.

The aim of this publication scheme is to explain what information the Forth Estuary Transport Authority (‘the Authority’) makes available to the public, and wherever possible provide an easy method of accessing this information. The Authority has regard to the public interest in the information it holds. In preparing to meet its obligation under the Freedom of Information (Scotland) Act 2002, including the drawing up of this publication scheme, it has been mindful of the value of openness and transparency.

This scheme has been approved by the Scottish Information Commissioner, who is responsible for enforcing FOISA.  The Authority is obliged to review the scheme from time to time.

Alongside FOISA, the Environmental Information (Scotland) Regulations 2004 (the EIRs) provide a separate right of access to environmental information that we hold.  This publication scheme also contains details of the environmental information that we routinely make available.

Where information is not published under this scheme, you can request it from us under FOISA or, in the case of environmental information, the EIRs.  For further information on accessing information not covered by this scheme, refer to Section 14 – How to access information not available under the scheme.
